During the last week, there have been some of the most unusual rumors being circulated about Clay Aiken and the first week sales of his debut album, Measure of A Man.

There is no doubt that Clay’s numbers were remarkable.  It wasn’t just the fans that were impressed; the music industry was in shock.

I am posting a copy of the latest list of Debut Album Sales for Idol Contestants.  It really reminds all of us just how amazing the numbers were for Clay.

Below the chart is the Press Release issued by BMG about Clay’s sales.  I think they were rather excited about the sales.

In a few months, the Season Eight Idols will be presenting their albums to the public.  It will be interesting to see where they fit into the list.

Aiken Has Second-Highest Sales Figure For a Debuting Solo Artist in the SoundScan Era

Measure Of A Man, Clay Aiken’s much-anticipated debut album, is already double platinum and had an extraordinary first week at retail, with sales of 613,000 copies and a smashing debut at No. 1 on The Billboard 200. Aiken has the third highest first-week sales figure of 2003, and the second-highest first week total of any debuting solo artist in the SoundScan era. Measure Of A Man sold more copies than any other album by a debuting solo artist since Snoop Dogg’s Doggystyle in December 1993.

The immediate success of the CD is the latest achievement in an amazing year for the 24-year-old native of Raleigh, North Carolina. On Oct. 14, 2002, he auditioned for American Idol for the first time. One year later to the day, his album Measure Of A Man was released by RCA. In reviewing Clay’s album as “the best pop album of 2003” Billboard magazine went on to say, “Every song, every note is brimming with glory. Throughout, the timeless production focuses squarely on Aiken’s immense talent. In another radio era, this album could be the Thriller of the day, spawning hit after hit. Measure of a Man is an utter triumph.

The album was recorded in Los Angeles, Miami, and London under the close supervision of album producer Clive Davis, American Idol creator Simon Fuller, and RCA executive Steve Ferrera. Among the songwriters and producers who contributed to the album are Steve Mac, Clif Magness, Desmond Child, Steve Morales, and Rick Nowels. In addition to original songs like I Will Carry You, No More Sad Songs, and I Survived You, the album contains Aiken’s current hit at radio, Invisible, and his platinum single, This Is The Night.

Shipping double platinum and debuting at No. 1 were just a part of the most memorable week in Aiken’s life. He also performed the National Anthem at the first game of the World Series, made his debut on The Tonight Show With Jay Leno, and appeared on Good Morning America, The Early Show, The View, and TRL.

As Measure Of A Man continues to fly off the shelves, there’s much more coming up for Aiken. He will perform live on The American Music Awards on Nov. 16. He has been nominated for Favorite Pop/Rock Male Artist as well as the Fan’s Choice Award. Aiken is also scheduled to appear on The Billboard Music Awards, live from Las Vegas on Dec. 10.

On November 25th, he’ll sing holiday favorites from the RCA album American Idol: The Holiday Classics on American Idol: Christmas Songs, a FOX-TV special airing at 8pm. On Nov. 27th he will participate in Macy’s Thanksgiving Day Parade and on Nov. 28th he’ll be one of the stars of Nick At Night Holiday Christmas Special.

David Pomeranz is one of the most successful and prolific songwriters and recording artists on the scene today. His songs and recordings have sold over 35 million copies worldwide and his musical projects have earned him a total of 18 Gold and 22 Platinum records. Billboard Magazine has referred to him as, “One of our finer voices…”and his concerts have delighted and inspired millions all over the world.

In 2008, Clay Aiken released a beautiful version of David’s classic song, “It’s In Every One Of Us” as a bonus track to launch his new album, “On My Way Here” on RCA.   “It’s In Every One Of Us” has been translated into numerous languages and its heartfelt message of hope is sung all over the world.

Some of the  artists who have recorded and/or performed David’s songs include Clay Aiken, Bette Midler, Richie Sambora (of Bon Jovi), Kenny Loggins, Freddie Mercury, Cliff Richard, Anna Nalik, Grover Washington Jr., Richard Marx, The Carpenters, Isaac Hayes, Phoebe Snow, Dennis DeYoung (of Styx), Hubert Laws, John Denver, Kenny Rogers, Harry Belafonte, Leo Sayer, The Muppets, Glen Campbell, The Hollies, Lea Salonga, Kathie Lee Gifford, Andrea Marcovicci, Cleo Laine and many more. In 2002, Missy Elliott sampled David’s music for her hit single, “One Minute Man” (Elektra) which went to the top of the Billboard Charts.

David has his hand in all fields of music. Besides being an active concert performer, David has written many songs for movies.  David’s recent composition, “The Art Of The Soul”, was featured in the 2008 Motion Picture Documentary, “As Seen Through These Eyes.” The film, narrated by Maya Anjelou, is produced by the Sundance Channel.

An Emmy Nominee for his song work on Television, David has contributed songs for scores of Series’ and Specials including, “Boston Legal” and “Will And Grace.”

From 1986-1992, David’s was the voice heard each week singing the theme to the hit series, “Perfect Strangers“

David is presently at work composing the score, in collaboration with Book Writers Joseph Stein (“Fiddler On The Roof”) and Jenny Lynn Bader, and lyricist Barry Harman (“Romance/Romance”) for a new Broadway-bound musical comedy.

“It’s In Everyone of Us” is a beautiful song.  We are fortunate that David wrote the song and lucky that Clay Aiken was able to record it!

There has been a great deal of discussion recently about contracts in the recording industry.  Because it was announced that Clay Aiken chose not to renew his contract with RCA, there has been much speculation about what he can and cannot do or say.

None of Clay’s fans are privy to his contract details so any discussion is just a guessing game that will probably never be answered.  However, it is possible to look at contracts in a general way and get some concrete facts.

Some research was done to write this article.  More important than the reading done on the subject, was the opportunity I had to sit down with three attorneys and discuss “what ifs” with them.  It made for a very interesting evening.

When asked why there was no discussion from either RCA or Clay Aiken about the end of their contract, four different scenarios were mentioned.

First, it was suggested that the contract has not yet ended.  When there are large contracts that need to be renewed, the negotiations usually start about a year before the contract is void.  This gives enough time for back and forth discussions that need to be studied.  If there is a stalemate and the two sides cannot come to agreement, the parties will not step into a new contract.  However, the old contract is still in place until the end of the contracted time.

The second suggestion regarding the current silent time was a Confidentiality Agreement. Also known as a non-disclosure agreement, it is simply a contract between two or more parties where the subject of the agreement is a promise that information will be maintained in secrecy. These types of agreements are usually used in the technical fields and when inventions and plans are important to a company.  A non-disclosure agreement might be a part of the original contract or could be signed when the contract is not renewed.

The third suggestion from the lawyers was the one that they thought might be the correct one.  It is a “Cooling-Off” Clause.   This particular clause is usually agreed upon when the parties break off negotiations.  It is used when there is apt to be bad publicity for either side.

There is a big difference between a Confidentiality Agreement and a “Cooling-Off” clause.  In a Confidentiality Agreement, discussing the secrets of the company and/or the contract will not be discussed for many years, or never.  A “Cooling-Off” clause is a temporary time to allow the news and discontent to….cool off!  It almost sounds too casual to be a part of a contract, but I was told it is used often in many fields and certainly makes sense in this case.

The fourth and final suggestion was really quite simple.  Perhaps both sides in this contract dispute decided to take the high road.  Since both sides knew that this was a contentious subject that would cause much publicity and discussion, perhaps they decided to not get involved in the fray.  This suggestion did come with a lot of laughter and eye-rolling.

We also discussed Non-compete Agreements, sometimes called a covenant not to compete.  In this agreement, the employee agrees not to pursue the profession in competition against the employer.  Most jurisdictions where such contracts have been examined by the courts have found them to be legally binding.  However, the clause must have reasonable limitations on the timetable.  The courts say that an individual cannot be barred from carrying out a trade in which he has been trained.  This clause is very controversial. Some jurisdictions, such as the state of California, do not allow non-compete clauses at all.

Would this covenant not to compete be a part of Clay’s contract?  It was agreed that this is a possibility. However, it would only have a short life.  After all, artists change labels all the time and still continue in their chosen field.  However, since all of this is speculation, we don’t have the full answer.

It was suggested that one other agreement is probably a big part of any Artist’s contract.  It is an Exclusive Agreement Clause.  It would prevent the Artist from entering a similar recording agreement with another recording company.  When the contract is in force, it prevents conflicts when two companies attempt to  market the same artist.

After the termination of the recording agreement, the Artist will continue to be bound by the terms of the Exclusive Agreement Clause for a period of time.

It is important to realize that non-compete, non-disclosure agreements and Exclusive Agreement Clauses are not related in any way.  There can be one of these in a contract without the others, or all could be included or not.

Please remember that no one that was involved with this article knows any personal information about Clay or his contract.  This article was only meant as an overview of general contract information.  If nothing else, perhaps it will spur some thoughts and discussions.

All of us hope that this new step in Clay’s professional career is going smoothly and that we will hear something soon about his future in the recording industry.  Perhaps then, all the speculation about his contract will come to an end and we can just enjoy his wonderful voice.

The Perfect Playlist from Clay Aiken

On Friday afternoon, Clay Aiken’s Official Fan Club announced the release of his new album.  Named Playlist: The Best Of Clay Aiken, the album will hit the shelves on March 31st, 2009.

The album is advertised as Clay’s perfect playlist and is being released through Legacy Recordings.

Since the announcement of this CD came on the heels of Clay’s departure from RCA, many fans have been speculating as to Clay’s participation in this CD.  According to the Fan Club, the playlist was handpicked by Clay from his four albums.

Included in the song-list is Clay’s #1 single “This Is The Night” and the ever popular “Solitaire.”

Legacy Recordings are pleased with the re-mastered songs on the album and proud that the packaging is environmentally-friendly.

Since this CD is being released with in-put from Clay, music lovers and Clay fans should be supporting this album so it can climb to the top of the charts.

Congratulations to Clay Aiken. He rated the number 1 position on the mainstream AC charts at Promosquad’s HitPredictors.  The results that were just recently published show that Clay was in the top position for the months of November, December and January.

According to the HitPredictor site, the chart is a gauge of an artist’s popularity, above and beyond the song charts.  Every aspect of the artist’s career is a part of the score. Chart performance is impacted by many different things, including marketing, airplay, TV appearances, the Internet and even rumors.

HitPredictor started its Internet based pre-testing in 2003 by turning to real music fans for their opinions.  A list of several hundred artists is compiled and the artists are rated by carefully screened music fans.

Songs are blind tested online by Promosquad using multiple listens and a nationwide sample of music consumers.  Songs are rated on a scale of 1-5;  final results are based on weighted positives.

Promosquad is a company that was founded on the axiom that radio is vibrant when it comes to delivering new music to the listening public.  They feel that radio still remains the biggest factor in the discovery of new music.  Tim Richards. A Clear Channel Programming VP says, “Today’s work schedule makes it more difficult to dedicate a lot of time to new music.  HitPredictor is a great tool for staying on top of music trends.”

So, in spite of the lack of radio support for Clay Aiken, he still is at the top of the charts.  Just think about the hits he would have if he had some support from the record executives who are supposed to be in his corner.

Yesterday, fans of Clay Aiken discovered that there were some changes to his RCA internet site, ClayAiken.com. It was later in the day that the following message was posted at Clay’s Official Fan Club site:
